Sometime after midnight, while most Americans slept, the President of the United States gave a 42-minute telephone interview to a far-right conspiracy theorist. And when Wayne Allyn Root suggested that Trump declare a “national security emergency” within the next month, ahead of the midterm elections, Trump did not shut it down. He did not say no. He said, “Let me just say, stranger things have happened. I’ll leave it at that.” Any president who believed in democracy would have said absolutely not, that the American people decide elections. Instead, the President of the United States refused to say he wouldn’t interfere in an election less than three months away.
Within days of being sworn in as Attorney General, Todd Blanche’s Justice Department published a memo expanding executive privilege beyond anything in modern history, extending it to conversations between the president and private citizens, business associates, donors, people the public never elected. The purpose is to block the congressional subpoenas Democrats are preparing for January before they even begin. Even Nixon only tried to shield conversations inside the White House, and the Supreme Court ruled against him unanimously. Trump and Blanche studied Nixon’s downfall and learned a different lesson: his mistake wasn’t hiding behind privilege, it was having only one wall. So they are stacking layers, each one covering the holes in another. The emergency threat covers what the privilege memo cannot, and there are surely more layers coming.
A federal judge issued a nationwide injunction blocking Trump’s executive order that would have directed the Postal Service to refuse delivery of mail-in ballots to states that wouldn’t hand over their voter lists, writing that the order was “threatening both increasing chaos and an erosion of trust in our democracy.” With fewer than 90 days to the election, the timeline is on our side. If they were confident Republicans would win, they would not be floating emergencies or rewriting privilege. They are building these plans because they are terrified of what happens if the system works as it is supposed to. The primaries are nearly done. Now it is our turn. We cannot sit back and hope someone saves us. We must save ourselves. I know we will.
