At 9:39 in the morning, Jack Smith stood before members of Congress, raised his right hand, and swore to tell the truth. Then he sat down and said words that should never have to be said about a president of the United States: “Our investigation developed proof beyond a reasonable doubt that President Trump engaged in serious crimes against our nation.” He described the scheme to overturn the election, the classified documents kept at Mar-a-Lago, and the repeated efforts to obstruct their return. Highly sensitive national security information had been held in a bathroom and a ballroom where events took place. And despite the threats directed at him by the most powerful man in the country, Smith made one thing absolutely clear: “I will not be silenced by continued threats of prosecution from the president or others.” Jack Smith is a man who had followed the evidence and refused to abandon it simply because telling the truth had become dangerous.
The Republicans across from him brought something completely different. Eric Schmitt thought he had caught Smith in a lie about a basketball game. He claimed text messages placed Smith at an Atlanta Hawks game, supposedly providing cover for a secret meeting with Fani Willis. He even had a poster board held up, then refused to show Smith the evidence he was using to accuse him of perjury. He called him a “villain” and a “total dirtbag.” But the game Smith attended was not the Atlanta Hawks. It was the Iowa Hawkeyes, playing at the University of Maryland. He had gone with a U.S. Marshals Service detail to watch Caitlin Clark. He was not in Atlanta, and he did not meet with Willis. Amy Klobuchar called for apologies, but Schmitt doubled down. I kept thinking about Joseph McCarthy waving a supposed list of communists into the air, letting accusations do the work of evidence. We know the damage that kind of performance can do. Watching more than four hours of this hearing, I was astonished by Smith’s composure while the people questioning him humiliated themselves trying to protect Donald Trump.
Even the administration’s new AI website could not keep the truth buried. Asked who won the presidential election in 2020, it answered that Joe Biden won and Donald Trump lost, citing the National Archives and the Electoral College results. We are living through a time when lies are manufactured with enormous money and resources behind them, and people who challenge those lies are threatened into silence. Every night I sit down to write, I think about my children and the possibility of grandchildren someday. I could not look them in the eye knowing I had chosen silence when I could have spoken. Smith reminded us that the truth does not need tricks or stunts. It needs people willing to keep showing up. “Fear may be contagious; courage is as well,” he said. That courage traveled far beyond the hearing room and into our homes. We have to keep speaking.
