ICE violated 96 court orders in 1 month, in 1 state alone
Sitting before the Senate Appropriations Committee, the new Secretary of Homeland Security was asked one of the simplest questions our system of government has: when a court orders DHS to stop doing something illegal, will you comply? Four times, Senator Chris Murphy asked, and four times Markwayne Mullin refused to say yes. “If we didn’t think courts were politicized, then I would probably be able to answer that,” he said. At one point, he didn’t even try to hide it, saying, “Not all judges are above the law, but sometimes they think they are.” Murphy told the entire committee they “should be really, really freaked out,” and named the stakes without flinching, “I think that’s actually the end of our republic, if the administration willfully ignores a court order because they disagree with it.”
And the question wasn’t hypothetical. Murphy read aloud from a ruling by Chief Judge Patrick Schiltz, a Republican appointee who clerked for Antonin Scalia, who found that ICE violated 96 court orders across 74 cases, in one state, in roughly a month. “ICE has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence,” the judge wrote. The whole system depends on officials obeying orders they don’t like. Mullin just told the Senate he may not.
But while one man in a hearing room was telling the Senate he might not honor rulings he dislikes, real Americans across six states were standing in line casting primary ballots. Votes were counted. Results were accepted, even by losers carrying the president’s endorsement. The democratic norms are still holding, because ordinary people keep showing up to hold them. That willingness to participate is exactly what we will need in November. And people are already proving they are ready to meet the moment.
